Evidence checklist for a disability claim

A disability claim is decided on the evidence in the record. These are the kinds of records and statements that commonly matter, grouped by type.

Medical records

  • Records from every provider, including recent treatment
  • Imaging and test results
  • Hospital and emergency-room records
  • Medication lists, with side effects
  • An explanation for any gap in treatment

Provider statements

  • A treating provider's statement on specific limits: sitting, standing, lifting, concentration, attendance, time off task
  • Specialist opinions where a specialist treats the condition

Symptom and treatment records

  • A log or journal kept over months: symptoms, severity, what could not be done
  • Treatment history: therapy, injections, surgery, medication trials

Work and daily activity

  • Work history for the past years, with job duties
  • Function reports describing daily activities

Statements from others

  • Family, friends, or former coworkers who have seen the limits day to day
